The Government have announced that it is abandoning the sunset clause in the Retained Law (Revocation and Reform) Bill which would have automatically repealed any retained EU law so that it expires on this New Year’s eve, unless there was specific legislation introduced to retain it. These include TUPE law, paid annual holiday and the 48 hour working week, among others.
Now the position is being reversed so that EU law will remain binding unless it is expressly repealed. The Government will publish a list shortly of the EU derived laws it intends to revoke from 31 December 2023.
