Since it was first published in 1993, this book has been extremely popular as a clear, straightforward reference to the law of highways. It covers the creation, maintenance, improvement and extinguishment of highways. The book explains the Common Law principles underlying highways and the rights of passage for the public and shows how Statute Law has developed in its provision for the protection and maintenance of highways. Many of the leading cases on matters such as obstruction and public nuisance are discussed.

Michael Orlik has now revised the text to a third edition to take full account of recent legislation, in particular the Traffic Management Act 2004, the Clean Neighbourhoods and Environment Act 2005 and the Natural Environment and Rural Communities Act 2006.

The change in the law on winter maintenance is covered and the recent cases on the important distinctions between the duties and the powers of the Highway Authority – on pavement tripping, on the procedures for making Traffic Orders and on definitive Map Modification Orders – are discussed. Material has also been included on decisions in highway cases where the Human Rights Act 1998 has had an impact, and on ascertaining highway widths and ‘ransom strip’ problems.

The basic structure of the book has been retained; the objective is still to provide full coverage of the law on highways ‘from cradle to grave’ in as straightforward a manner as possible without being either over-simplistic or too complicated.
